Court Spared Buruji Kashamu From Extradition

NDLEA and police should stay away of scandalous senator-elect Buruji Kashamu. According to decision ruled by Justice Okon Abang of the Federal High court in Lagos, their latest moves to extradite Kashamu to the United States are unlawful.

Buruji Kashamu’s extradition saga is far from its end. Justice Okon Abang of the Federal High court in Lagos ruled out a decision forbidding the Nigeria Police, the National Drug Law Enforcement Agency, the State Security Service and the Nigerian Customs Service to arrest and extradite Buruji Kashamu to the United States.
Justice Abang told the law enforcement agencies failed to comply with the Extradition Act.
He insists that they should follow this law if they want to arrest and extradite Kashamu to face drug-trafficking charges in the US.
Justice Abang insisted the court wouldn’t prevent NDLEA oк the police from further Kashamu’s drug case investigation but all legal actions including arrest and possible extradition must be carried out in accordance with the letter of the Extradition act.
The respondents cannot be perpetually restrained from arresting the applicants but are restrained from unlawful arrest of the applicant without compliance to the provision of the extradition act”, told Justice Abang delivering his judgement on Kashamu’s case.
The judge also awarded a cost in the sum of N20,000 against the NDLEA, the Attorney General, the National Security Adviser to the President, and the Nigeria Security and Civil Defence Corps.
In response to his prosecution by the law enforcement agencies Buruji Kashamu filed a counter-suit indicting‎ the Chairman of the NDLEA, Ahmadu Giade, NDLEA itself, the Inspector General of Police, SSS, the Attorney General of the Federation and Minister of Justice, the Nigeria Customs and the Nigeria Immigration Service of violating his fundamental rights.
 Justice Ibrahim Buba has reportedly ordered yesterday the National Drug Law Enforcement Agency (NDLEA) to immediately vacate Buruji Kashamu’s residence.
The saga started on Saturday, when the NDLEA laid siege on Kashamu’s residence. Since then the senator-elect, wanted by the US authorities on suspicion of drug trafficking, had been under house arrest over the extradition case.
At the same time US District Judge in Chicago Charles Richard Norgle told that the Justice Department was “fully ready to ensure that an express hearing is given” as soon as Kashamu is brought to the US to face drug trafficking charges.
According to Judge Richard Norgle, Kashamu stole his deceased brother Adewale Kashamu identity to get a Nigerian passport and used this document to smuggle drugs from Nigeria and Benin to the US.

Kashamu was arrested in the UK in 1998 and held in prison for five years, but was released due to the inability of British judges to prove that Buruji Kashamu is the same person as Adewale Kashamu, who was wanted in the US court under this name.
